The São Paulo Court of Justice confirmed a decision that exempts Souza Cruz from paying compensation for damages possibly caused by cigarettes. This time, the 5th Chamber of Private Law of the TJ denied an appeal from the widow of a smoker. In June 2001, Margarida Ferreira Serafim Fernandes filed a claim for compensation in court for material and moral damages, alleging that her husband died because of an illness associated with cigarette consumption. She stated that her husband started smoking induced by Souza Cruz advertising, which made no mention of the risks of smoking.
