For this jurist “the consignment account works well for making transfers and consignments. It is a useful tool that Banco de Santander created a little over 35 years ago and it has improved a lot. It is becoming easier to enter the money requested in any procedure. There is an issue that could be improved and that is having access to the extracts of movements that are not easy to have.”
In the opinion of the Madrid dean “the new instruction that the LAJs have to enter 200 characters to make these payments does not seem very operational. It does not Fax Lists correspond to any procedural or effectiveness reason, but we do not see it operational. This harms and slows down the collection of court orders. In that money pending to reach its recipient we have legal costs, consignments for traffic accidents or bail.”
In his opinion, “none of the statistics we manage does it appear at any time to what type of procedures the amount that is deposited is used, but everyone is surprised that this amount is deposited without being distributed among its beneficiaries. That amount should be in the hands of individuals and companies that are worthy of that money. Having those more than 4,000 million euros is not a management success.”

From his point of view, an immediate solution to this problem must be found: “The attorneys could advance the orders, due to the powers we have with clients, but this is not done either. There the LAJs refuse that these return orders be in favor of the attorneys when if I have the representation of the party there should be no obstacle to collecting those amounts. But we are not there yet.”
Looking to the future, García contemplates that “ after six months of strike and a discouraging future outlook, the situation of justice is catastrophic . ” It is difficult to explain to the defendant why we have reached this juncture. The trend is not for improvement. Our judicial system is a failed system that still works by inertia, the delays are enormous in the first instance. Hence, we demand a Pact for Justice with all the legal operators who sit at the same table and organize it better.”
