Rádio Mix, from São Paulo, is prohibited from continuing with the Bundão da Escola promotion . The São Paulo Court accepted the request for an injunction, in a Public Civil Action, filed by the São Paulo Public Ministry.
In the action, the MP alleges that the campaign, aimed at teenagers, encourages the violation of image rights, especially of children and teenagers, calling on them to take “their camera, their cell phone and go hunting for the biggest asshole in the school: It could be a friend, a beadle, a teacher…”.
The action states that the average Special Data number of listeners to Rádio Mix per minute is 152,300 people, 72% of whom are aged between 10 and 29 years old.
According to the Prosecutor of Justice for Children and Youth, Martha de Toledo Machado, “the illicit conduct of the radio encourages the practice of violence among an indeterminable number of students in our schools; psychological and moral violence, humiliating, discriminatory, vexatious and even racist practices; and violence that can spill over into harming the physical integrity of children and adolescents.”
In case of non-compliance with the decision, the arbitrated fine is R$25,000 per day.

The competition encourages the frank violation of the image rights of an indeterminate number of people, especially children and teenagers, urging them to think about “your camera, your cell phone and go hunting for the biggest ass in your school: it could be the beadle, a friend, a teacher... The result will be in October”, that is to say, with the “disclosure of images whose connotation is notoriously offensive, joking, disrespectful of the human dignity of each child or young person involved in the nefarious promotion” (page 11), without not even worry about making the display of these images subject to the essential authorization of the right holder (or their legal representative).
It violates fundamental rights constitutionally guaranteed to the human person, especially of an indeterminate number of children and adolescents, people in training and recipients of special and priority policies, in the facets of the right to physical and mental integrity, image, honor, decorum, and intimacy, among others. It also encourages violence, humiliating, discriminatory and vexatious practices among an indeterminable number of students in our schools.
